AN ACT TO AMEND CHAPTER 970, LOCAL AND PRIVATE LAWS OF 1997, TO AUTHORIZE THE BOARD OF SUPERVISORS OF JACKSON COUNTY, MISSISSIPPI, ACTING THROUGH THE JACKSON COUNTY PORT AUTHORITY, TO EXTEND THE WATER AND SEWER SERVICES OF SUNPLEX LIGHT INDUSTRIAL PARK; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Chapter 970, Local and Private Laws of 1997, is amended as follows:
Section 1. (1) For the purpose of enhancing commerce, industry and sport fishing in Jackson County, Mississippi, the Board of Supervisors of Jackson County, in its discretion, is authorized to designate certain property located in Section 14, Township 7 South, Range 8 West, in Jackson County, Mississippi, as a dredge material disposal area. However, no such designation shall be valid unless it complies with all federal and state environmental laws.
(2) In addition to the authority granted in subsection (1) of this section, the board of supervisors shall have the authority to designate other dredge material disposal areas in Jackson County if the board deems such action to be necessary. Any such designation must comply with all federal and state environmental laws.
Section 2. The Board of Supervisors of Jackson County, Mississippi, acting by and through the Jackson County Port Authority, is authorized and empowered, in its discretion, to extend the water and sewer lines of the Sunplex Light Industrial Park water and sewer system to areas outside the park to make water and sewer available to commercial service, general business and residential development in the Mississippi Highway 57 area north of U.S. Highway 90 and extending northerly through the intersection of Robinson Still Road and Mississippi Highway 57.
Section 3. The Board of Supervisors of Jackson County, acting by and through the Jackson County Port Authority, is further authorized, in its discretion, to apply for grants and/or acquire by donation, purchase, lease or otherwise, such funds, properties, rights-of-way or easements, and/or to enter into such contracts and agreements with other public governing authorities, entities and private contractors, to accomplish the purposes set forth in Section 2 of this act.
SECTION 2. This act shall take effect and be in force from and after its passage.
